Currently (as of March 2009), New Jersey law imposes serious penalties on individuals convicted for marijuana related offenses. In many cases, judges must impose "mandatory minimum sentences" (MMS) for convicted defendants - regardless of whether or not they empathize with a given defendant's position or personally believe NJ's marijuana laws are way too strict. A defendant who gets an MMS must either serve out that sentence or serve out an alternative even-more-severe sentence.
What's more, if you are arrested with fewer than 50 grams of marijuana on your person, you can get sentenced to half a year in jail and $1,000 in fines. Furthermore, if you're charged with "cultivating" marijuana, you can be slapped with a felony charge and be forced to serve one and a half years in prison and pay a fine of $10,000 - even if you've grown less than a single ounce of marijuana!
There is some hope on the horizon for marijuana defendants in New Jersey. On February 23, 2009, the New Jersey Senate passed landmark legislation that approved the use of medical marijuana to treat qualified patients. If the bill passes the NJ Assembly, New Jersey will the 14th State in the Union to adopt Medical Marijuana Laws. Even if this bill does pass the Assembly and gets signed by Governor Corzine, however, it's very unlikely that it will have any retroactive effect. Thus, for instance, if you got arrested in November of 2008 for a marijuana violation, changes to NJ's law won't likely impact your case.
