Marijuana Laws in New Jersey
New Jersey lawmakers and the Governor recently passed medical marijuana legislation. But our state's marijuana laws are still some of the toughest in the nation for anyone caught possessing, selling, growing or transporting marijuana. There are mandatory sentencing requirements, and a conviction, even on a minor possession charge, can have lasting consequences. Possession
- Fifty grams or less can result in up to six months in jail and a $1,000 fine.
- More than 50 grams is a felony and can lead to 18 months in jail and a $25,000 fine.
- Possession of marijuana within 1,000 feet of a school can result in incarceration and fines based on the amount plus a minimum of 100 hours of community service.
Cultivation
Cultivation of marijuana in New Jersey is a felony offense and is based on the number of plants seized:
- Less than 10 plants can result in up to five years of incarceration and fines up to $25,000.
- 10 to 49 plants can result in up to ten years of incarceration and fines up to $150,000.
- 50 or more plants carries a mandatory minimum sentence up to 20 years in prison and up to $300,000 in fines.
Distribution or Possession With Intent to Deliver
All distribution and possession with intent convictions are felony offenses in New Jersey and are based on amounts:
- Less than one ounce can result in up to 18 months in jail and a $25,000 fine.
- At least one ounce, but less than five pounds, can result in up to five years in prison and a $25,000 fine.
- At least five pounds, but less than 25 pounds, can result in up to ten years in prison and a $150,000 fine.
- More than 25 pounds can result in up to 20 years in prison a $300,000 fine.
As previously mentioned, possession with intent within 1,000 feet of a school, selling to a minor or to a pregnant woman can lead to much harsher penalties.
