- Less than one ounce can result in third degree charges and lead to 18 months in jail and a $25,000 fine.
- At least one ounce, but less than five pounds, can result in second degree charges and lead to up to five years in prison and a $25,000 fine.
- At least five pounds, but less than 25 pounds, can result in first degree charges and up to ten years in prison and a $150,000 fine.
- More than 25 pounds can result in up to 20 years in prison and a $300,000 fine.
However, in New Jersey, other factors can significantly increase the length of incarceration, the amount of the fine and other penalties for trafficking. These factors include the following:
- A trafficking conviction within 1,000 feet of a school zone results in a mandatory sentence of three years in prison and mandatory parole ineligibility.
- A trafficking conviction within 500 feet of a public library, public housing or park results in a mandatory sentence of five to ten years in prison.
- Possessing a handgun in connection with a trafficking charge can result in ten to 20 years in prison.
